CLOTHING CONSIGNMENT CONTRACT13413 SAN PEDRO, SAN ANTONIO, TX 78216 (210) 340-2422This is a Consignment Agreement between the Merchandise Owner (Owner), and TOO GOOD TO BE THREW (TGTBT). The parties agree as follows: Name Name First First Last Last Consignor Account Number Date 1. * I Agree: Owner appoints TGTBT as an agent for the sale of items of merchandise consigned with TGTBT for a period of 90 days from the date of consignment. All prices are determined by TGTBT. At the end of the initial 30 day consignment period, TGTBT will reduce the sales price of the consignments by 20%. After an additional 30 day consignment period (60 days total), TGTBT will reduce the sales price of consignments by 20% more. In addition, TGTBT may further reduce items according to sales events or unforeseen condition of items regardless of the date of consignment. One-time VIP Membership dues of $10.00 will be deducted from your first consignment check. This will give you exclusive on-line access to your account at all times.2. * I Agree: TGTBT shall pay Owner 40% of the sales price for items priced under $100.00, 50% of the sales price for items priced between $100.00 and $999.00, and 60% of the sales price on items listed for $1000.00 or more.3. * I Agree: Items that are not sales floor ready will be charged $2.00 per item for steaming or cleaning expenses, if necessary. Items that are damaged or are no longer seasonal may be donated at any time. If TGTBT comes across an item, after initial inspection, that we are not able to add to your account due to damage or wear, TGTBT will donate item.4. * I Agree: Owner must give notice 10 days prior to Consignment Expiration Date in order to pick-up any items not sold. Only items priced above $50.00 will be eligible for pick-up. Any items not reclaimed by Owner one week after set pick-up date will become the exclusive property of TGTBT and may be sold to recover expenses or donated to a charitable organization. Any items priced below $50 will become the exclusive property of TGTBT and may be sold to recover expenses or donated to a charitable organization at the end of the 90 day consignment period. A tax receipt will be available upon request for any items donated by TGTBT. It is the Owner’s sole responsibility to monitor the consignment term.5. * I Agree: There is a buyer’s fee added to each item, based on the price of the item. This fee is a small amount added to the cost of an item and is not part of the split. Example, an item priced at $85 may have a $3.95 fee added and the tag will read $88.95. Your split will be calculated on the $85 price of the item. The $85 is what you will see listed in your on-line account.6. * I Agree: Owner may pick-up item(s) before consignment term is up, however, there will be a 20% penalty fee based upon the original sale price of each item pulled. Once Owner has contacted TGTBT to pull items early, Owner has 7 days to pick-up items. If item(s) are not picked up in 7 days, item(s) will be returned to Owner’s account and placed on the sales floor until consignment period ends. Payment for returned item(s) will be either deducted from account or paid upon pick-up.7. * I Agree: TGTBT shall make every effort to protect your consignments. However, all risk of loss of consignments is specifically retained by Owner. TGTBT shall not be responsible for any damage to or loss of Owner’s merchandise for any reason. Please check with your Homeowner’s Insurance Agent to confirm coverage of these items while at TGTBT.8. * I Agree: Commission checks or Direct Deposit for Consignor earnings of $75 or more are issued for the prior month’s sales by the 20th of the next month. Effective June 1, 2024 a $5.00 processing fee will be deducted for each check issued and a $3.00 processing fee will be deducted for each Direct Deposit. Consignor shall be responsible for any fees associated with lost checks by mail. Payments for Consignor earnings less than $75 will be payable in cash in store at the end of the consignment contract, or if all active items have been sold. It is the sole responsibility of the Consignor to inquire about consignment earnings associated with this agreement. Earnings for layaway transactions are payable to the consignor on the check issued after the final payment.9. * I Agree: This agreement shall cover all items presently or hereafter consigned with TGTBT by Owner and shall continue in force until terminated or superseded by an agreement bearing a later date. This buyer’s fee will replace the buyer’s fee stated in Section (5) of CONSIGNMENT CONTRACT. Example, a designer handbag that we price for $1000 will have a $24.95 fee attached and will show $1024.95 on the tag. Your split will be calculated on the $1000. If the Designer item is authentic, a certificate will be printed and placed with the item. This authentication certificate will add value to your item and will remain with the item upon sale of said item.2 * I Agree: If the item cannot be verified by ENTRUPY or THE FASHION DETECTIVE as Authentic then the item will be returned and a fee of $30 will be charged to Owner for the cost of the authentication.3. * I Agree: Owner must give TGTBT notice 10 days prior to Consignment Expiration Date in order to pick-up items not sold, or to reconsign items not sold. If Owner does not give said notice on designer items priced over $200, TGTBT may reconsign select items in Owner's account for an additional 90 day consignment period at a minimum reduction of 20%. Each time item is reconsigned, the price will be lowered a minimum of 20%. If an item has been reconsigned two (2) times, Owner must make arrangements to pick up item. Any items not reclaimed by Owner one week after set pick-up date will become the exclusive property of TGTBT and may be sold to recover expenses or donated to a charitable organization.
